Content Policy

A space for everyone

Tesa is a community of creators and fans. These guidelines keep the platform safe, authentic and lawful. They are written to comply with Kenyan law — including the Computer Misuse and Cybercrimes Act, 2018, the Films and Stage Plays Act (Cap 222), the Copyright Act, 2001, the Children Act, 2022, the Sexual Offences Act, 2006 and the National Cohesion and Integration Act, 2008. By posting on Tesa you agree to follow them and to comply with the law.

Adults only

You must be 18 years or older to create an account, post or purchase content on Tesa. Every person who appears in content you upload must also be an adult who has given clear consent to appear and to the content being monetised. We may ask you to verify your age or the age and consent of people in your content, and we will remove content and close accounts where this cannot be shown.

What we encourage

Original content you created or have the rights to share.
Respectful conversation, even when you disagree.
Clear, honest descriptions and pricing of paid and exclusive content.

Zero tolerance: children

Any content that sexualises, exploits or endangers a person under 18 is strictly prohibited. This is a serious criminal offence under the Children Act, 2022, the Sexual Offences Act, 2006 and section 24 of the Computer Misuse and Cybercrimes Act, 2018. We remove such content immediately, permanently ban the account, and report it to the Directorate of Criminal Investigations and relevant child protection authorities. There are no second chances.

What is not allowed

Non-consensual content — sharing intimate images or videos of any person without their consent is an offence under section 37 of the Computer Misuse and Cybercrimes Act. This includes "revenge" content and hidden-camera material.
Harassment and threats — cyber harassment, stalking, bullying and threats of harm (sections 27 and 32 of the Computer Misuse and Cybercrimes Act).
Hate speech and incitement — content that stirs up ethnic hatred or discrimination (section 13 of the National Cohesion and Integration Act) or incites violence.
Fraud, scams and impersonation — phishing, pyramid schemes, fake giveaways, impersonating another person or Tesa staff (sections 29 and 30 of the Computer Misuse and Cybercrimes Act; Consumer Protection Act, 2012).
False or misleading publications intended to deceive (sections 22 and 23 of the Computer Misuse and Cybercrimes Act).
Intellectual property infringement — content you did not create and have no licence to distribute (Copyright Act, 2001).
Content restricted by film classification law — content that has been refused classification or that violates conditions imposed under the Films and Stage Plays Act and Kenya Film Classification Board guidelines.
Illegal goods and activity — promotion or sale of drugs, weapons, wildlife trophies, unlicensed betting, or any other activity that violates Kenyan law, including the Prevention of Terrorism Act, 2012.
Privacy violations — publishing another person's personal data (doxxing) contrary to the Data Protection Act, 2019.

Copyright and takedowns

If you believe content on Tesa infringes your copyright, you may send us a takedown notice under section 35B of the Copyright Act, 2001 (as amended in 2019). Your notice should identify the work, the infringing content, your rights in it, and be signed. We act on valid notices within the statutory timelines, notify the uploader, and terminate the accounts of repeat infringers. Knowingly sending a false takedown notice is itself an offence under the Act.

Enforcement

When content breaks these rules we may remove it, limit its reach, suspend payouts connected to it, or take action on the account involved — up to permanent removal from the platform for serious or repeated violations. Where the law requires it, we preserve evidence and cooperate with the Office of the Data Protection Commissioner, the Kenya Film Classification Board, the Directorate of Criminal Investigations and other lawful authorities. If you believe we made a mistake, you can appeal through your account settings and a human will review the decision.

Reporting

If you see something that breaks these guidelines, report it. Every report is reviewed and helps keep Tesa safe for the whole community. Reports involving an immediate risk to someone's safety should also go to the police — dial 999 or 911, or report online abuse to the DCI.
